you at this time. This website at www.brainintegration.institute (“Site”) is owned and operated by the Brain Integration Institute, LLC (“BII”, “Owner”, “us”, “we”, or “our”). To help ensure good communication and an understanding of our services, we have provided you as a user of this Site (“you” or “your”) with the privacy policies that govern your use of the Site or your involvement with BII. If you continue to use our Site or participate in events or activities listed on the Site, or you request any services from us, you consent to these policies and agree that these policies apply to govern our interactions. We may update these policies from time-to-time, and you agree that your continued use of our services or Site constitutes your acceptance of the updated policies.

Please read this privacy policy carefully. If you do not agree with the terms of this privacy policy, please do not access the Site, but please also share with us your concern(s) as we would like to know how we can better serve you.

At BII we strive to promote brain integration through a variety of means, including using our website to share information with others. We also work to provide information about practitioners and the work they do. This means that we do work to facilitate the sharing of some information with those we serve, but we are not in the business of selling your information to others that are not connected with our work or efforts.

This Privacy Policy is effective as of the “Last Updated” date below. We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of this Privacy Policy. Any changes or modifications will be effective immediately upon posting the updated Privacy Policy on the Site, and you waive the right to receive specific notice of each such change or modification.

You are encouraged to periodically review this Privacy Policy to stay informed of updates. You will be deemed to have been made aware of, will be subject to, and will be deemed to have accepted the changes in any revised Privacy Policy by your continued use of the Site after the date such revised Privacy Policy is posted or by attending or participating with any of our events, activities, or classes offered or provided to you or others.

You are under no obligation to provide us with personal information of any kind, however your refusal to do so may prevent you from using certain features of the Site and you may be unable to register for events or other services offered. Information our servers or software program may automatically collect when you access the Site or your account, such as your IP address, your browser type, your operating system, your access times, and the pages you have viewed directly before and after accessing the Site. Financial Data

Financial information, such as data related to your donation method (e.g. valid credit card number, card brand, expiration date, billing address, name on credit card, etc.) may be collected when you donate or request information about our services from the Site. With most of the financial information, such information is stored by our payment processor. Please understand that when you make a purchase from our Site, you will be providing financial information to a third-party.

Information obtained from third parties connected to the Site, such as plug-ins, payment providers, contact us forms, or other services or software offered or provided by third parties. Publicly on Website

Any information provided to us to create profiles, to list certifications, or to promote any type of information about brain integration may be used by us on the Site and disclosed publicly. The public display of information is limited to the information associated with the various sets of information contained on the Site (such as certificate information for those who have received a certificate and remain in good standing, or information related to discipline or loss of certification).

By Law or to Protect Rights

If we believe the release of information about you is necessary to respond to legal process, to investigate or remedy potential violations of our policies, to comply with our legal obligations, to have attorneys review our legal obligations, or to protect the rights, property, and safety of others, we may share your information as permitted or required by any applicable law, rule, or regulation. POLICY FOR CHILDREN

BII itself does not provide services directly to children, but practitioners often helpnchildren with a variety of services. Despite this, BII does not knowingly solicit information from or market to children under the age of 13. Rather, we work to conduct all business and online transactions with parents. If you become aware of any advertising or efforts directed at children under age 13, please contact us using the contact information provided below. Also, you agree to not provide any healthcare information on or through this Site. Only provide healthcare information to practitioners in appropriate, private settings to help safeguard your and your child’s health information.

We do not knowingly use any information about children under age 13 for marketing or solicitation purposes. If a child under age 13 is enrolled by a parent or guardian in an event or other service, the child’s personal information will be used to identify them in that particular event and may be shared with the practitioner or presenter as necessary. However, the personal information of a child under age 13 will not otherwise be knowingly used by us. We do not knowingly send advertisements to children under age 13, but instead communicate with the child’s parent or guardian and use the parent’s or guardian’s information in accordance with this Privacy Policy. If you become aware of any use of the personal information of a child under age 13 outside the scope of an event or service the child is enrolled in, please contact us using the contact information provided below.

CONTROLS FOR DO-NOT-TRACK FEATURES

CALIFORNIA PRIVACY RIGHTS

California Civil Code Section 1798.83, also known as the “Shine The Light” law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. Governing Law

You agree that your use of this Site, these privacy terms, the services and any disputes relating thereto shall be governed in all respects by the laws of Utah, without reference to conflict of laws principles. You agree to submit to personal jurisdiction in Utah for any disputes related to this Site, these Terms, or BII’s services. Any dispute relating to this Site, these Terms, or BII’s services shall be first submitted to mediation in Utah, and if mediation is unsuccessful or a party refuses to attend mediation within 30 days of receiving a written demand for mediation, then such dispute shall be resolved solely in the state or federal courts located in Salt Lake City, Utah. You waive any defenses to such forum or venue. Further, in the event that a breach of these Terms or other issues would threaten irreparable harm to a party, the party may file a case directly in court for relief without first being required to mediate such issue(s).
